1.About Fairway
Fairway ("Fairway", "we", "us") operates this members-only golf society web application. The app lets members log rounds, track their handicap, join events, and share posts with other members. Fairway is not a golf club or a course operator; we do not organise, marshal, insure or supervise any round of golf played by our members.
This page is maintained by Fairway to explain how the app works. It is not legal advice and is not an independent certification of anything.
2.Membership
You must be at least 18 years old, provide accurate registration details, and keep your login credentials confidential. You are responsible for all activity carried out under your account. We may suspend or terminate any account that breaches these Terms or that poses a risk to other members.
3.Assumption of risk
Golf is a physical activity that involves inherent and obvious risks including, without limitation, being struck by golf balls or clubs, slips, trips and falls, physical exertion, exposure to weather, buggy and cart incidents, injury caused by other players, and travel to and from courses.
You take part in every round, event, meet-up, competition and any other activity organised, posted or arranged through Fairway entirely at your own risk.You are responsible for judging whether an activity is safe and appropriate for you, for arranging your own insurance, and for following the rules and instructions of the course you are playing on.
4.Limitation of liability
To the maximum extent permitted by law, Fairway, its owners, admins, moderators and volunteers shall not be liable for any loss, injury, illness, death, theft, property damage, financial loss, disappointment, distress or dispute arising out of or in connection with:
- your use of, or inability to use, the app;
- your participation in any round, event or meet-up organised or promoted through the app;
- the conduct of any other member or any third party (including course staff);
- reliance on scores, handicaps, leaderboards, course data or any other information shown in the app;
- content posted by members, including photos, comments and messages;
- travel to or from any course or venue.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot lawfully be excluded or limited under the laws of England & Wales.
5.Member conduct
You agree to behave respectfully towards other members and to follow the rules, etiquette and health-and-safety requirements of every course you play. Harassment, discrimination, threats, cheating, doxxing or unlawful content are not tolerated and will result in account termination.
6.Your content
You retain ownership of anything you post — photos, captions, comments, scores. By posting, you grant Fairway a worldwide, non-exclusive, royalty-free licence to host, display and distribute that content inside the app so that other members can see it. You are solely responsible for your content and confirm that you have the right to share it.
You can delete your own posts at any time. Cached copies may persist briefly after deletion.
7.Handicaps and scores
Handicaps and leaderboards inside Fairway are for the private, social use of members. They are not an official CONGU, WHS or R&A handicap and must not be relied on for entry into external competitions.
8.Accounts, suspension and termination
You may close your account at any time by contacting us through the in-app Help tab. We may suspend or close accounts that breach these Terms, that create risk for other members, or where required by law. On closure your profile is removed and your posts may be deleted or anonymised.
9.Changes to these Terms
We may update these Terms from time to time. The "Last updated" date at the top will change and material changes will be highlighted in the app. Continuing to use Fairway after an update means you accept the revised Terms.
10.Governing law
These Terms are governed by the laws of England & Wales. The courts of England & Wales have exclusive jurisdiction over any dispute arising out of or in connection with them, subject to any non-waivable rights you have as a consumer.
